You state that you have a citation from Nelson County that Basil Hayden performed a marriage ceremony there in 1784, and you think he had authority to perform marriage ceremonies for members of the Catholic faith. No, he could not have such authority. He was one of the early pioneers and must have been acting as Justice of the Peace, but not being a priest could not have authority to administer the Sacrament of Matrimony. In our Church the only Sacrament that may be administered by a layman, Catholic or Protestant, is Baptism, and that only in an emergency. Of course, the church recognizes the validity of marriages of non-catholics by their own ministers or by officers of the law, but Catholics must be married by a priest.
Father de Rohan coming to Kentucky in 1790 had faculties for North Carolina, and married a number of catholics in Kentucky, and Father Badin, who succeeded him, thought that these marriages were invalid and made a serious error in advising Catholics to be married over again, but upon appeal to Bishop Carrol he was, of course, overruled, who rightly held that although de Rohan had no faculties for Kentucky the marriages were valid, but that de Rohan should be suspended. We have the same principle in law, the acts of de facto officers are always recognized as valid. I would like to have the Basil Hayden citation so when I go to Bardstown I will look it up.
